Terms and Conditions

These Terms govern your use of the Manch online dispute-resolution platform. By signing in you accept these Terms together with the Privacy Policy and Code of Conduct.

1. Service description

Manch provides a digital platform for the conduct of arbitration and mediation proceedings under the Arbitration and Conciliation Act, 1996, and applicable institutional rules. Manch is a service provider; it is not the tribunal, and it does not adjudicate.

2. User obligations

  • Provide accurate information and keep it current.
  • Comply with the Code of Conduct and tribunal directions.
  • Safeguard your account credentials. You are responsible for activity under your account.
  • Pay any fees due under your scheme of engagement on the platform.

3. Tribunal authority

Substantive and procedural decisions in any matter — including interim measures under Section 17 of the Arbitration and Conciliation Act, 1996 — rest exclusively with the tribunal seized of that matter. Manch will not grant, deny, or vary any interim measure; that authority is the tribunal's alone, in line with the kompetenz-kompetenz principle in Section 16 of the Act.

4. Liability

To the maximum extent permitted by law:

  • Manch is not liable for the substantive correctness of any award, order, or decision rendered by a tribunal.
  • Manch is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, business, data, or goodwill arising out of your use of the platform.
  • Aggregate liability for direct damages is capped at the fees paid to Manch in respect of the matter giving rise to the claim in the twelve (12) months preceding the claim.

5. Intellectual property

The platform, its software, branding, and content (excluding party submissions) are the property of Manch and its licensors. You receive a limited, non-exclusive, non-transferable licence to use the platform for the proceedings to which you are a party.

6. Modification and termination

We may modify these Terms with notice. Continued use after notice constitutes acceptance. We may suspend or terminate accounts for breach of these Terms, the Code of Conduct, or applicable law.

7. Arbitration of platform disputes

Any dispute arising out of these Terms or your use of the platform — distinct from the underlying matter on the platform — shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, seated in Mumbai, before a sole arbitrator appointed in accordance with Manch's institutional rules.

8. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to clause 7, the courts at Mumbai shall have exclusive jurisdiction.

9. Notices

Notices to Manch: info@manch.live. Notices to you will be sent to the email or phone number on your account.

10. Severability

If any provision of these Terms is held unenforceable, the remainder continues in full effect.
